This Privacy Notice is applicable to the personal data that AurumCore, S.A.P.I DE C.V, (hereinafter “AurumCore”).

We are aware of the importance of the legitimate, controlled and informed treatment of the personal data of users. In virtue of the above, we make available to you this Privacy Notice through which we inform you about the treatment that will be given to your personal data and other information that is collected.

Personal Data and Sensitive Data

AurumCore respects the privacy of any individual who visits our website or interacts with us in any way. You can consult our websites without providing personal data. There are several ways within our website or job boards where you will provide us with personal data such as mail address and electronic address (e-mail). If you choose to share any information with us, it will be stored and used internally solely and exclusively to review, analyze, study, evaluate and perform any other activity related to placement and management with job boards, job applications, placement of personnel with AurumCore clients, commercial prospecting, contracting of services, purchase/sale of products and collection.

The information collected is:

  • Personal Information: Name and surname, date of birth, gender, R.F.C., Social Security number (I.M.S.S.), age, date of birth, nationality, email, immigration status (in case of foreigners), credits with INFONAVIT, Unique Population Registry Code, bank account number for payroll deposit, provision of services and/or for commercial contracts, information on direct relatives and/or economic dependents, passport, immigration form and/or immigration status in case of foreigners, social networks.
  • Contact Information: Address, contact telephone numbers, email, official identification.
  • Recruitment information: Academic history, employment history, job position, work experience.
  • Information Sensitive Data: Medical history, blood type, medical treatments, contact information for emergencies.
  • Asset and/or financial data.

Purposes

The purpose of obtaining and processing your personal data obtained by any means will be, in order to comply with the legal and business relationship that you have with us: the identification of you as a user and client; the sale and acquisition of the products and/or services offered; to provide you with the services purchased; to issue electronic invoices for the contracted services and provide you with said invoices. Also, for marketing, advertising and commercial prospecting purposes; to inform you about the launch of new products and services; to make recommendations about said products and services; quality control of our products and services; suggestions and/or to evaluate the quality of the services that we provide you.

To manage the commercial, personal, or service relationship, it is necessary to:

  • Comply with our legal and contractual obligations.
  • Maintain and monitor the service provided.
  • To handle any type of requirement, request and/or complaint from our business partners, clients, suppliers or candidates.
  • To update and register clients and/or suppliers and/or candidates in our system for the placement of personnel with clients, business partners or subsidiaries of AurumCore.
  • To identify and compare signatures of legal representatives and for the celebration of any agreement and/or contract and/or conventions.
  • Identification and recognition of candidates, service providers and/or clients and/or suppliers.
  • Procedures and follow-ups on invitations and support at events in which AurumCore participates.
  • To carry out banking operations on behalf of the data holder in the event that there is an employment relationship between him/her and AurumCore. Considering that consent is not required for this purpose.
  • To comply with the requirements established by law to correctly configure an employment relationship between the holder of personal data and AurumCore. Considering that consent is not required for this purpose.

Regarding transfers that require consent:

The transfers that require your consent are tacitly accepted by you by being aware of this Privacy Notice, on the use of your personal information and being duly informed of the data that was collected and for what purposes, accepting the terms contained that were prepared in compliance with the Federal Law on the Protection of Personal Data Held by Private Parties, otherwise you can exercise your ARCO rights (access, rights of access, etc.).

Security Measures

AurumCore has adopted the necessary technical, administrative and physical security measures to ensure the integrity of your personal data and prevent any damage, loss, alteration, destruction or unauthorized use, access or processing. Authorized personnel are prohibited from allowing access to unauthorized persons and from using your personal data for purposes other than those described in this privacy notice. The obligation of confidentiality of the persons involved in the processing of your personal data remains even after the relationship with AurumCore has ended.

Transfer of Personal Data

AurumCore may transfer all or part of the personal data within its subsidiaries, business partners, clients, service providers, companies that are in charge of processing or conducting customer satisfaction surveys. The transfer of personal data may be national or international. In any case, third parties process the information on the instructions of AurumCore and have assumed contractual obligations with AurumCore and its subsidiaries in other countries, in order to protect the personal data of our clients, suppliers and candidates for the placement of personnel services with clients, business partners, service providers. Since AurumCore has international reach, your personal data may be communicated to other companies in our same corporate group. Therefore, your data may be transferred to our affiliates, which are located outside of Mexico. Our organization's subsidiaries, business partners, clients, and service providers, who may receive or consult your personal data, have implemented measures and policies for the protection of the personal data of our clients, business partners, suppliers, and candidates for vacant positions at AurumCore. These policies are consistent with those of AurumCore and seek to comply with the regulations applicable in each country.

AurumCore may be a party to a corporate transaction (including mergers, spin-offs, sale of assets or shares, corporate restructuring, among other transactions). As part of AurumCore's assets, your personal data is part of these assets, and you agree that AurumCore may communicate your personal data to third parties in the context of the transactions mentioned in this paragraph. The third parties mentioned include, among others, the acquirers of assets, legal, accounting, financial, auditing, and other advisors who participate in the transaction. We will only disclose your personal data to such third parties to the extent that the disclosure is necessary to evaluate or complete the transaction or when the transfer is necessary as a result of the transaction.

ARCO Rights

In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations, hereinafter LFPDPPP, you have the rights of Access, Rectification, Cancellation and Opposition to Processing (the “ARCO Rights”); you also have the right to revoke at any time the consent granted for the processing of your personal data to the extent permitted by law.

To exercise your ARCO Rights or your right of revocation or to formulate any questions or complaints regarding the processing of your personal data, please contact AurumCore’s Legal Affairs department. If you wish to know if there are options available for you to limit the use or disclosure of your personal data for a specific treatment, please consult our Legal Affairs department at AurumCore. Your requests will be evaluated under the terms established in the LFPDPPP and other obligations applicable to AurumCore, which will communicate in accordance with the following:

  • The name of the owner, address and/or email or other means to communicate the response to your request.
  • The documents that prove your identity or, where appropriate, the legal representation of the owner.
  • The clear and precise description of the personal data in respect of which you seek to exercise any of the aforementioned rights.
  • Any other element or document that facilitates the location of the personal data.
  • In the case of requests for rectification, the owner must indicate the modifications to be made and provide the documentation that supports their request.
  • AurumCore will communicate to the owner, within twenty business days from the date on which the request for access, rectification, cancellation or opposition was received, the determination adopted in order that, if appropriate, it will be made effective within fifteen business days following the date on which the response is communicated.
  • The aforementioned deadlines may be extended once for an equal period, provided that the circumstances of the case justify it.

Access

The obligation to access information will be deemed fulfilled when the personal data is made available to the owner through any means of communication.

Revocation

The owner of the personal data may revoke his/her consent for the processing of personal data at any time, and must, for such purposes only, send a written request to the Legal Affairs area at the address indicated in the first paragraph of this notice and/or through the following email account: info@aurumcore.com. AurumCore, within the following twenty business days from the date on which the revocation request was received, will inform the owner of the admissibility or inadmissibility of the same and if it is admissible, it will be made effective within fifteen business days following the date on which the response is communicated to the email provided by the owner.

Changes to this email

AurumCore will modify or update this privacy notice to address legislative or jurisprudential developments, international treaties, internal policies, new requirements for the provision or offering of the services it offers. These modifications will be available through the AurumCore website (www.aurumcore.com).

General consent

Having made this Privacy Notice and its modifications available to the Owner, either personally or through the website or other means, and not having immediately expressed any opposition, it will be understood that the owner has tacitly consented to the processing of his/her data. If the owner provided his/her data verbally, in writing, by electronic, optical or any other technology, or by unequivocal signs, it will be understood that he/she has given his/her express consent.
